Wieneke Legal

Frequently Asked Questions

Who does Wieneke Legal represent?

Wieneke Legal serves policyholders and insurers alike. Clients include residential and commercial property owners, insurers and claims organizations, and attorneys on either side who need Alabama property coverage counsel. Every engagement is subject to a conflict check.

Where is Timothy Wieneke licensed to practice law?

Timothy Wieneke is licensed to practice law in Alabama only and is not admitted to practice law in North Carolina. Wieneke Legal LLC operates remotely from North Carolina and does not maintain a bona fide office in Alabama. The firm provides legal services only in matters and jurisdictions in which its attorney is authorized to practice. All engagements are subject to conflicts review and a written engagement agreement.

What is a property insurance coverage opinion?

A coverage opinion is a written legal analysis of whether, and to what extent, a property insurance policy applies to a particular loss. It reviews the insuring agreement, exclusions, conditions, and endorsements against the facts in the claim file. Wieneke Legal LLC provides coverage opinions on first-party property insurance matters governed by Alabama law.

What is Coverage Triage?

Coverage Triage is a focused review and preliminary analysis of a defined property coverage issue. It is not necessarily a formal comprehensive coverage opinion.

What is a reservation of rights letter?

A reservation of rights letter is a notice from an insurer that it is continuing to investigate or adjust a claim while preserving its right to deny or limit coverage later under identified policy provisions. Wieneke Legal can analyze the coverage issues a reservation of rights raises and, when engaged by an insurer, prepare the letter.

What does a coverage position letter address?

A coverage position letter communicates a coverage decision on a claim, such as acceptance, partial acceptance, or denial, and explains the policy provisions and facts on which it rests. Wieneke Legal drafts coverage position letters based on a completed coverage opinion and the client’s coverage decision.

When might outside coverage counsel be useful?

Outside coverage counsel can help when a claim presents a disputed coverage question, unfamiliar policy language, competing causes of loss, a large or complex commercial loss, or a question about the scope of Business Income coverage. Insurers, policyholders, and their attorneys may each benefit from a written coverage analysis before a position is taken.

Does Wieneke Legal calculate Business Income losses?

No. Business Income work addresses the applicability and scope of Business Income and Extra Expense coverage. It does not include loss calculation or quantification, which is determined by the adjuster, a forensic accountant, or another appropriate professional.

How are fees set?

Depending on the nature and complexity of an assignment, services may be available through fixed-fee or hourly arrangements. Fees are determined after conflicts screening and review of the proposed scope of work. A written engagement agreement will identify the services, applicable fees, and payment terms before work begins.

How do I engage Wieneke Legal?

Email or call with a brief description of the coverage question, the policy form, and the parties involved. A conflict check is completed first. After conflicts are cleared and the proposed scope is reviewed, the firm provides an engagement proposal. Do not submit confidential or privileged information until conflicts screening is complete and an attorney-client engagement has been confirmed. Assignments are handled remotely from the electronic claim file.

What is Timothy Wieneke’s background?

Before practicing law, Timothy Wieneke spent more than 20 years in property claims, handling in excess of 8,000 first party residential and commercial claims as an adjuster, consultant, expert and appraiser. He holds a J.D. from Stetson University College of Law and the CPCU and AIC designations, and holds construction contractor licenses in North Carolina and Florida.
